General Terms and Conditions
LEASE BROKERAGE
When a lessor instructs the Agency to act as a broker in a lease of his/her property, or when a lessee instructs the Agency to connect him/her with the person who would negotiate with him on concluding a lease agreement, or when a lessee instructs the Agency to act as a broker in finding a suitable property for a lease, the agency will conclude a brokerage contract/order with him/her.
The Agency is obligated to verify the ownership of the property that is the subject of lease, to organize a presentation of the property in question, to carry out negotiations necessary for reaching an agreement on the lease of the property in question, to organize drafting of the lease agreement and to attend the takeover of the property, at which occasion the takeover protocol is drafted.
BROKERAGE FEE FOR A LEASE
The amount of the brokerage fee shall be determined pursuant to the Price List of the Croatian Chamber of Economy.
The agency fee shall be paid when signing the lease agreement.
LEASING OUT - Commission payable by the lessor:
For a lease of 1 to 5 years: 100% of one monthly rent + VAT
For a lease of 5 years or more: 150% of one monthly rent + VAT
The said fee represents one half of the total commission, while the other half shall be collected from the lessee of the relevant property.
TAKING ON A LEASE - Commission payable by the lessee:
For a lease of 1 to 5 years: 100% of one monthly rent + VAT
For a lease of 5 years or more: 150% of one monthly rent + VAT
The said fee represents one half of the total commission, while the other half shall be collected from the lessor of the relevant property.
PREMIUM SERVICES
We charge our services depending on the selected scope of the services. The services are charged on a monthly basis.
SERVICES OF BROKERAGE FOR THE SELLER
When a Seller instructs the Agency to act as broker in the sale of his/her property, the Agency will sign a brokerage contract with the Seller.
By signing the property brokerage contract, the Agency commits to perform the following activities for the Seller (Client):
- Try to find and connect the Client with a person with whom the negotiated transaction will be signed.
- Inform the Client about the average market price of similar properties
- Examine the documents proving ownership or other proprietary rights over the property and warn the Client of obvious defects and possible risks in connection with unregulated land-registry status of the property; registered proprietary rights or other rights of third parties to the property; legal consequences of failing to meet the obligations toward third parties; deficiencies of the building permit and occupancy certificate under a special act; and details of the mandatory application of pre-emption rights and limitations in legal transactions under special regulations.
- Take necessary actions in order to present the property on the market; adequately advertise the property, and carry out any other actions agreed in the property brokerage contract that are beyond the scope of regular presentation, for which the Agency shall be entitled to reimbursement for special, pre-announced expenses.
- Enable inspection of the property.
- Mediate in negotiations and invest efforts to facilitate the signing of the agreement.
- If the property in question is a land property, verify the intended purpose of such land property under the applicable physical planning regulations.
BROKERAGE FEE PAYABLE BY THE SELLER
The amount of brokerage fee shall be determined pursuant to the Price List of the Croatian Chamber of Economy.
The Agency fee shall be paid upon signing the preliminary sale and purchase agreement.
For brokerage services provided in the sale and purchase of a property, the Seller shall pay to the Agency a commission in the amount of 2 – 10% of the agreed selling price + VAT. This fee shall represent one half of the total commission, while the other half shall be collected from the Buyer of the property.
The Agency reserves the right to change the amount of the brokerage fee, which shall be specified in the brokerage contract. The amount of the total fee shall not exceed 10% of the selling price of the property + VAT.
SERVICES OF BROKERAGE FOR THE BUYER
When a Buyer instructs the Agency to connect him/her with the Seller of a property or when the Buyer instructs the Agency to mediate in the purchase of a property, the Agency shall sign a brokerage contract/order with the Buyer. By signing the property brokerage contract/order, the Agency commits to carry out the following activities for the Buyer (Client):
- Disclose to the Buyer proof of ownership of the property being sold.
- Organize verification of the signatures on the preliminary sale and purchase agreement or the final sale and purchase agreement by a Notary Public.
- In the case of partial or full payment of the selling by means of a bank loan, attend the solemnization of the loan agreement in a Notary Public's office, after which the request for registration of the mortgage is submitted to the Land Registry Department of the competent court, so that the mortgage can be registered.
- After the mortgage is registered, deliver to the Buyer the registration certificate and land registry excerpt with the mortgage duly entered.
- Attend payment of the selling price and the handover of the property, at which occasion a handover protocol is drafted.
- Inform the Buyer of the mandatory payment of real estate transfer tax or of the conditions for exemption from real estate transfer tax.
